Renovation to a residence in a Flood Plain Westchester County architects
There are many considerations to renovating an existing residence located in a flood plain in Westchester County, NY. An owner may not add value to a home more than 50% of the value of the home (not including the land) if the home is in a designated flood plain and if the home is not at least 14 feet above flood plain level. Determining the home's value less the land is not easily done and many towns will not consider the insurance value as adequate for the value of the home less the land. When the house is located in an area where the land is very valuable, as in a waterfront community, the house's value without the land may be low, thereby impeding the owner from adding much value without raising the home up to at least 14 feet.

Homes with 3rd floors looking to make them into habitable space need special consideration. Generally, a sprinkler system is required plus code compliant emergency egress window. If you are going to finish a 3rd floor space, you need to fulfill the sprinkler system and emergency egress requirements before you can obtain a C.O.
If your 3rd floor was finished without a building permit, this improvement must be legalized before a Certificate of Occupancy (sometimes called a Certificate of Compliance) will be issued by the town. This requirement in under the Residential Code of New York State.

Westchester architect Michael McCann- residential architect
As an architect and builder, I am working on a lovely home in New Rochelle which used to belong to the famous acting duo of Peter Lind Hayes and Mary Healy. This imposing tutor sits adjacent to Pelham Country Club and overlooks the golf course in Westchester County on Mt. Tom Road. The house's driveway for 70 years exited onto a service road belonging to Pelham Country Club. The Club allowed the access but never formally gave an easement. The owners called me when the sale of the home wasn't progressing due to the hesitation by the buyer to purchase the home without a formal, legal easement. I drew plans redirecting the driveway so that the property can be entered from the public street and am having the new driveway modified.The house will not not have to use the access road of Pelham Country Club and the closing on the sale of the house can proceed shortly.

Michael McCann, Westchester architect and builder, will be published in the Shoreline Press publications in May. Michael wrote an article for the five Shoreline publications regarding legalization and C.O. problems faced by owners trying to sell or refinance their home. Title and mortgage companies, doing an examination of the home's records at the local town hall discover discrepancies between the features that exist in the home and what is recorded at the town hall and will not give clear title without these discrepancies being clear up. Therefore the sale or refinance cannot proceed. As a residential architect, Michael has seen numerous situations where sellers have risked losing a loan or sale because an improvement to their house was never filed with the local building department by obtaining a building permit and getting the proper inspections. Local building departments in Westchester tell owners that they need a plan drawn up by a licensed architect, file the building permit and get the improvement legalized. Architect Michael McCann practices architecture in Westchester and Fairfield counties in addition to the Hamptons and NYC.

Many towns in Westchester County, NY levy fines when a residential owner has a home improvement done without filing a building permit. Some towns are assessing heavy penalties. New Rochelle, for example, has a fine of $2000 regardless of whether or not the owner instituted the remodeling or home improvement or if the upgrade to the property was present when the current owner purchased the home.

Legalizations, Building Permits, and Certificate of Occupancy
Architect Michael McCann is seeing an uptick in clients asking for legalization and Certificate of Occupancy resolutions. As a residential architect and builder, Michael was recently called by a potential client regarding the legalization of a basement remodel. The owner had just installed a new boiler which required final inspection by his town located in Westchester County. When the inspector came to see the boiler he noticed that the basement had been refinished without a builder permit. The inspector then told the owner that he would not complete final inspection of the boiler without the basement being legalized through obtaining a building permit. This requires filing architectural plans with the building department, filing appropriate electrical and plumbing applications. The town would then inspect the basement for code compliance. As an architect Michael has resolved many of these situations.
